General F. Records
- Records, Retention and Access. The Co-op will maintain adequate operational records for the Development and the following apply:
- the Co-op will retain all documents, vouchers, records and accounts that pertain to the Development for not less than seven years following the date of receipt or production of those records;
- the City or its agents may inspect all records maintained by the Co-op for the Development after giving reasonable notice, at any reasonable time, and may make extracts from and take photocopies of those records; and
- upon reasonable notice, in accordance with the City's obligations pursuant to the Freedom of Information and Protection of Privacy Act, the Co-op will, upon request:
- disclose to an Occupant the Co-op's file for the Occupant; and
- cooperate with the City if the City has a request to disclose third party information under the Freedom of Information and Protection of Privacy Act,
subject to the Co-op's compliance with its obligations under that Act and any other applicable legislation.
- Information Management. The Co-op will:
- collect information and, if applicable, create and retain records in relation to Occupants during the Term of this Agreement, as required by this Agreement, all in accordance with the requirements of the Personal Information Protection Act as applicable;
- notify the City immediately upon becoming aware of any breach of security involving the unauthorized collection, use, disclosure or destruction of information relating to the Development;
- treat as confidential all information or material provided to the Co-op by the City, by Occupants, or by third parties if the information concerns Occupants and is relevant to this Agreement;
- keep all documents and records produced or received by the Co-op in relation to this Agreement segregated from other documents to the extent it is practical to do so; and
- safeguard records and not permit their disposition or destruction without the prior written consent of the City, except as required by applicable law, including the Document Disposal Act.
